Terms of Service

SpiderWeave.com has a responsibility to protect each client and to provide the best services available. The following guidelines were designed to ensure these obligations are met.

Content:
All services provided may be used for lawful purposes only.  Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold us harmless from any claims resulting from the use of the service which damages the subscriber or any other party. We will be the sole arbiter in determining violations of this provision. Also prohibited are sites that promote any illegal activity or present content that may be damaging to our servers or any other server on the internet. Links to such materials are also prohibited. Any sites or links to other sites that promote or support illegal activity, offensive material, hate related actions, crimes or subject matter.

Examples of unacceptable content or links:

  • Pirated software or archives
  • Illegal Pornographic or Illegal Pornographic related sites
  • Spamming and Spam Software or Program Links
  • Hacker programs or archives
  • Warez sites or archives
  • Hate Related Site

SpiderWeave.com, will be the sole arbiter as to what constitutes a violation of this provision. Any violation may result in immediate suspension of site until removal of material and files or possible termination of contract without a refund.

Commercial Advertising – Banner Advertising on Site:
Please be assured, we will never impose forced advertising on any domain hosted by Spider Weave.com.

Background Running Programs:
We may allow programs to run continually in the background as long as they do not effect the other domains on the server or if they do not take up to many resources and effect the performance of the server.. These are considered on a case-by-case basis and an extra charge will be incurred based on system resources used and operational maintenance needed.

IRC:
We currently do not allow IRC or IRC bots to be operated on our servers. If an account is found to be using an IRC or IRC bots the account will be deleted from the SpiderWeave.com Network.

Server Abuse:
Any attempt to undermine or cause harm to a server, or customer is strictly prohibited.

Anti-Spam:
SpiderWeave.com is committed to a ZERO-TOLERANCE, Anti-Spamming policy. Under this policy, we Prohibit All Spam, and / or any unsolicited commercial email, from being sent either: Over the SpiderWeave.com Hosting network, by customers or any other users of the SpiderWeave.com Hosting network (including our customers’ customers); AND/OR over ANY network— if the message sent advertises or mentions a site hosted on the SpiderWeave.com Hosting server. We also prohibit the selling or installing of products that can be used for spamming.

We react quickly and seriously to any violations of this policy with IMMEDIATE SUSPENSION of the domain in question, and we further reserve the right to terminate without refund the services of a domain, without prior notice. We are constantly running email checks monitoring the amount of emails all accounts send out to prevent a spammer from sending out large amounts of email. In addition all new accounts go through a undetermined monitoring period of all scripts and all email lists. All email sending forms are also prohibited from being installed on our network with out the direct authorization of our Support Team. If a domain found to be using an unauthorized email script or program the domain will be immediately until direct phone contact is made with the domain owner and the script is removed. If you have any complaints or comments regarding Spam on our network, please direct them via email to support@spiderweave.com

Refusal of Service:
We reserve the right to refuse, cancel, or SUSPEND service at our sole discretion. We are committed to running a clean family orientated environment. We do not and will not allow any content that has to do with nudity, pornography, spamming, illegal activities, software piracy, profanity, or anything else that would be offensive in any manner. If a domain that is hosted by Spider Weave.com, is found to be indulging in such activities, we will pull the plug and immediately SUSPEND the domain, no questions asked and no refunds. All Sub-Networks, Resellers, distributive hosting sites and dedicated servers must adhere to the above policies.

Limitation of Liability:
SpiderWeave.com shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from SpiderWeave.com’s servers going off-line or being unavailable for any reason whatsoever. Further, SpiderWeave.com shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of SpiderWeave.com’s servers. All damages shall be limited to the immediate termination of service. SpiderWeave.com shall be the sole arbiter of what is and is not a violation of these acceptable use policies. SpiderWeave.com reserves the right to terminate an account at any time and for any reason that causes harm to any SpiderWeave.com customer’s web sites. SpiderWeave.com reserves the right to delete all content and files upon termination. SpiderWeave.com reserves the right to refuse, cancel, or suspend service at our sole discretion. SpiderWeave.com is not responsible for any damages or orders lost for e-commerce sites due to suspension of service or server down time. SpiderWeave is not responsible for temporary email loss or temporary email usage loss due to 3rd party blocking lists.

SpiderWeave.com reserves the right to change these Policies without prior notice or warning. Non-enforcement of any part of these Policies does not constitute consent. Violations of these Policies should be referred to support@spiderweave.com

General Billing information – Web Hosting:
Customers have the option of billing service on a monthly, quarterly, semiannual or they may receive an initial discount if they choose to pre-pay one year of service. We accept VISA, Master Card, American Express, Pay-Pal or Check payments. All payments for hosting or any other web services provided by SpiderWeave.com or its partners that are 14 days past due will be subject to SUSPENSION of SERVICES until payment in full is received. Sites that are over 21 days past due or SUSPENDED for more than 7 days will be charged a $19.95 reinstatement / late fee in addition to full balance due to reinstate the site. Sites that exceed allowed transfer will be automatically charged the current rate of monthly transfer plus a set up fee. (Site contacts will receive notices as to exceeding monthly transfer limits prior to exceeding their allowed data transfer). Suspended sites will be deleted and all files will be removed from the SpiderWeave.com Network if left suspended for 31 days. Site that are removed for past due balance of more than 31 days or sites that are removed for policy abuse issues are no eligible for any refund of service fees. All stand alone “Pure” Dedicated servers are required to have on file with a valid credit card. Stand alone dedicated server are not billed using our automated software and will become due 10 days prior to original sign up date. If the credit card is not active the server may be subject to suspension until the card is updated. All dedicated servers are billed 10 days prior to sign up date to ensure payment has been received.

Domain Name Registrations:
Domain name transfers: $25.00 per domain plus any registration fees that are due. Domains not hosted with SpiderWeave.com cost $38.00 for 2 years to renew. If domain is suspended due to late payment there will be a $25.00 per domain reinstatement fee. ALL DOMAIN NAME CANCELLATIONS OR TRANSFER NEED TO BE AT LEAST 60 DAYS BEFORE RENEWAL DATE.

Credit Card Billing (Automated):
If an account has been signed up to pay by credit card our automated system will bill you card monthly, quarterly semiannual or annual unless you change the billing cycle in your control panel. If a credit card has been declined for any reason our system will attempt to bill the card again in 5 days. If an account has not received payment after 14 days it is subject to suspension. SpiderWeave.com is not responsible for any bank charges accrued by an overdrawn bank account or any extra bank fees. Sites that are over 21 days past due or SUSPENDED for more than 7 days will be charged a $19.95 reinstatement / late fee in addition to full balance due to reinstate the site. Suspended sites will be deleted and all files will be removed from the SpiderWeave.com Network if left suspended for 31 days. Site that are removed for past due balance of more than 31 days or sites that are removed for any policy violation or abuse issues are not eligible for any refund of service fees. All stand alone “Pure” Dedicated servers are required to have on file a valid credit card. Stand alone dedicated servers are not billed using our automated software and will become due 14 days prior to original sign up date of each month. If the credit card is not active the server may be subject to suspension until the card is updated. All dedicated servers are billed 10 days prior to sign up date to ensure payment has been received. All dedicated servers are required to have a full 60 days prior to sign up date notice before cancellation. All domain names registered with Spiderweave.com will be billed 14 days prior to registration date. All domain names as well as all other services will use our automated billing software.

Refund Policy
Each of our hosting plans carries a 30 day money back guarantee. If you are not completely satisfied with our services within the first 30 days of your contract, you will be given a full refund of the contract amount excluding mandatory setup fees (if any), and applicable domain registration fees. If you are on a monthly price plan and are past your initial 30 days of service, there are no credits due. If you choose a yearly price plan and cancel your service after 30 days, you will receive a pro-rated credit for the service unused less a $55 account cancellation fee. If balance does not exceed $55.00 then there will no refund given.

Note: This policy does not apply to dedicated servers, any additional services such as shopping carts, dedicated servers, any 3rd party software or modules, data transfer overages, additional disk space, additional pop accounts, web design, secure server certificates, web promotion, web managing, domain registration, suspended site fees, set up fees, late fees or reinstatement fees, etc.

Account Cancellations
Any account cancellation must be submitted by logging into your account and fill our the cancellation request form a faxed letter to 570-422-6708. Phone requests will not constitute acceptance of any cancellation. If accounts are left unpaid owners will be subject to reoccurring hosting fees plus any collection costs. All dedicated servers are required to have a full 60 days notice before cancellation.

How to close your hosting account

  1. Log into your client area
  2. Click on “My Products & Services”.
  3. Next to the product to be canceled click on the View/Edit button (little green arrow).
  4. Scroll down, click on Request Cancellation
